Terms of Service

These Terms of Service (“Terms”) govern your use of VoiceDesk, operated by Nextwave Automations (“we,” “us,” “our”). By creating an account or using VoiceDesk, you agree to these Terms. If you do not agree, do not use the service.

Service Description

VoiceDesk is a software-as-a-service platform that provides AI-powered voice receptionist capabilities for businesses. The service handles inbound phone calls, manages appointment scheduling through Google Calendar, sends confirmations via email and SMS, and delivers call summaries and recordings to your dashboard.

Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree to provide accurate information when creating your account, notify us promptly of any unauthorized access, and ensure anyone in your organization who uses VoiceDesk complies with these Terms.

Acceptable Use

You agree not to use VoiceDesk to:

  • Violate any applicable local, state, national, or international law.
  • Abuse, manipulate, or exploit the AI system in ways that degrade service quality for other users.
  • Impersonate individuals, organizations, or government entities through the platform.
  • Use the service for automated telemarketing, robocalling, or unsolicited bulk communications.
  • Attempt to reverse-engineer, decompile, or extract the underlying models or algorithms.
  • Interfere with or disrupt the service infrastructure.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

Billing & Payment

VoiceDesk offers monthly and annual subscription plans processed through Stripe.

  • Subscriptions renew automatically at the end of each billing cycle unless canceled beforehand.
  • You may cancel your subscription at any time. Access continues through the end of the current billing period.
  • Pricing may change with 30 days' written notice before your next renewal.
  • Refunds are evaluated on a case-by-case basis. Contact us within 14 days of a charge to request review.
  • You are responsible for applicable taxes on your subscription.

Service Availability

We make commercially reasonable efforts to keep VoiceDesk available but do not guarantee uninterrupted or error-free operation. There is no formal SLA. Scheduled maintenance will be communicated in advance when possible. We are not liable for damages resulting from downtime, including missed calls or scheduling failures during outages.

Intellectual Property

The VoiceDesk platform — its software, design, branding, and documentation — is the property of Nextwave Automations, protected by applicable copyright and trademark laws. You retain full ownership of your business data, call scripts, customer information, and any content you provide through the platform.

Limitation of Liability

To the maximum extent permitted by law, Nextwave Automations is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of VoiceDesk, including lost profits, lost revenue, lost data, or business interruption. Our total liability for any claim related to the service is limited to the fees you paid us in the twelve months preceding the claim.

Termination

Either party may terminate this agreement with 30 days' written notice. You can cancel through your account settings or by contacting us directly. Upon termination, call handling stops at the end of the notice period and your data is deleted within 30 days, except where retention is required by law. We may terminate your account immediately for material violations of these Terms.

Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law provisions. Any legal action arising from these Terms shall be filed in courts located in Tennessee.

Changes to These Terms

We may update these Terms periodically. Material changes will be communicated via email at least 30 days before they take effect. Continued use of VoiceDesk after changes become effective constitutes acceptance of the updated Terms.
